your Wedding Photography Contract

Client agrees to the following contract with Katie Slater Photography for a wedding photography session.

RETAINER FEE + PAYMENT:

The client agrees to pay the photographer the retainer fee of 50% of total package (payment 1) in order to lock in the date and session. The retainer is a non-refundable fee. This covers the date and talent of the Photographer, professional editing of images, as created by the photographer, and a gallery of images which will be provided in a digital gallery link. The remaining payment is due 1 month from wedding date (payment 2). Each payment is non-refundable as you go and secures your date. Any additional hours or services will be added to the final invoice.

TRAVEL + LOCATION COSTS:

The client will be responsible for any fees or costs pertaining to the location that the client has chosen for the session. All LOCAL travel, accommodation, and location costs will be covered by the photographer. Travel cost will be added for any weddings off the Outer Banks due to the distance and travel expense.

RE-SHOOTS + EDITS:

Reshoots are determined at the discretion of the photographer. Reshoots will not be given for poor choices of clothing, hair and makeup, design, or weather related issues not previously discussed. The photographer is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The photos will be delivered with professional, creative editing and cropping, and therefore cannot be altered, filtered over, or re-edited by the client or anyone with access to the photos. If you need to see any changes on the editing after gallery delivery, there will be an additional extended time fee.

DELIVERY: 

The photographer is not obligated to provide every image taken during the event. The selection of images delivered to the client will be made at the photographer's discretion. Additionally, the photographer will not deliver RAW or unedited files. You can expect a 'sneak peek' of your gallery within one week of your event date, with the full gallery being delivered up to 8 weeks afterward. Please note that film photography can be uniquely unpredictable. By adding film to your wedding day, you acknowledge that any unexpected occurrences—such as light leaks, faded colors, development issues, or shipping delays—are not the responsibility of the photographer.

SHOOTING TIME / ADDITIONS: 

The client acknowledges that cooperation and punctuality are crucial to achieving the goals and expectations of all parties involved. Photography will begin at the scheduled start time and conclude at the scheduled end time. If the client arrives late for the event, the session will still begin and end as originally scheduled. Any additional time beyond the agreed-upon end time will be billed to the client.

ARCHIVES:

All images are available for 6 months following the client’s gallery delivery date. After 6 months, all images have no guarantee as backup on the photographer’s end. Photographer is not responsible for lost or damaged digital files due to circumstances beyond the photographer’s control. The client is expected to download the gallery to have as a backup copy of all digital photography that they will be responsible for. It is recommended that the client stores their copy on a hard drive, USB, dropbox, or any sort of cloud storage.

VENUE AND LOCATION LIMITATIONS: 

The photographer is limited by the rules and guidelines of the location(s) and site management. The client is responsible for acquiring all permits and necessary permission for all locations on which the photographer will be performing services.

MODEL RELEASE:

The photographer asks that all parties, including minors covered by an adult in this shoot agree to the use of photos in the photographers social media, portfolio, or business related marketing usage.

LIABILITY:

The photographer is not responsible for any injuries inflicted upon participating parties. The individual involved in injury will be responsible for themselves and their party, or other members of the shoot, and releases the Photographer from any claims against their person or their business.

ALT PHOTOGRAPHER + PHOTOS

In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, health circumstance, or other cause beyond the control of the photographer, the photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event.

In the unlikely event that digital and film files have been lost, stolen, or destroyed for reasons beyond the photographer’s control, including but not limited to hard drive errors, lost in shipping, or equipment malfunction, the photographer liability is limited to the return of partial payments received for the event. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package.

COPYRIGHT + OWNERSHIP:

The photographer retains all copyrights to all images created during the client’s session. It is illegal to copy, scan, download, print, or alter any image created by the photographer without their prior consent.

PHOTO RIGHTS:

The photographs from this session are only to be used under the client’s personal name. The photos cannot be shared or used for any third party use including but not limited to: another business’s advertisement, marketing, website, or print. The photos are limited to the paying client, model(s), makeup artist, vendors (social media and website only), or those on set at the time of the shoot only and cannot be shared further for profit. Katie Slater Photography must be contacted to extend the rights to any or all photo(s) to a third party business.

RESCHEULE:

To reschedule, Katie Slater must be notified a minimum of 3 months in advance. No amount will be refunded that has been paid to the date of cancellation.
